High Court Rider Allowing Resale of Registered Plots in Unauthorized Layouts in Tamil Nadu

In continuation of the ruling passed on by Madras High Court of removing the ban on Sale of Unapproved plots across the state in 28 March 2017 for individual plots has been further regularized on May 8th 2017. The ban was laid on sale and registration of unapproved plots and layouts in Tamil Nadu in September 2016 in answer to the Public Interest Litigation filed by Elephant G. Rajendran to safeguard agricultural lands being converted into housing plots on a large scale across the state. Strict actions were advised by the court to the authorities to be carried out of the court’s order was to be overruled by individuals.

The 9 September 2016 ban was revoked on March 28 2017 in order to safeguard the interests of the individual land owners who have purchased unauthorized lands for personal use. The regularization scheme announced by Tamil Nadu Government has been given a nod by Madras High Court with some rider. Any unauthorized plot registered within the time range of September 9 2016 to March 28 2017 will be nullified as it was under a ban. The registrations of 9760 plots fall under this blanket and have violated the court’s orders so cannot be registered so. The ban had been pulled through to save agricultural lands and the ecology to prevent floods. The ban has been removed to safeguard the individuals who are innocent of the amassing the unauthorized plots. The court has given a heads up for a Government Order where it has been announced that under Tamil Nadu Regularization and Unapproved Layout and Plot Rules 2017 land owners and layout promoters to apply for regularization of their unauthorized plots procured before October 20 2016. Failing to which the facilities like power connection, water supply and drainage facilities would be snapped for the same.
